The Environment Agency have now appointed consultants to audit a random sample of the ESOS audits that took place over the past year and a half but the major effort now is with those companies that for whatever reason have not yet complied. Penalties will be stiff. £50,000 for non compliance. An additional £500 per day to a maximum £40,000 (and given final grace period was 29 April, that makes 153 days to date or £76,500), the figure has already been surpassed.
The Agency have always been clear that to penalise was their last resort. If you feel you may be exposed to ESOS and have not yet carried out the work, get in contact https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/509835/LIT_10094.pdf - Page 7 sets out the criteria to be met. We can quickly and discretely assess whether or not you are captured by the legislation and if you are, can negotiate on your behalf anonymously in an attempt to gather a grace period to carry out the work. With experience of having conducted 18 ESOS audits to factories, airlines, logistics and distribution, major hauliers, offices and warehousing, we can conduct the process for you in its entirety and bring you to full compliance.
